Terms of Service

URLOCAL, provides web hosting, domain, and web design services to its clients.

URLOCAL agrees to provide services to the Customer, subject to the following Terms of Service. The usage of "us", "we", "our" shall constitute reference to URLOCAL, the usage of "you", "your" shall refer to the Client / Customer of URLOCAL.

Use of URLOCAL's services constitutes acceptance and agreement to URLOCAL's Terms of Service.

Modifications to this Policy.

Modifications to this policy may occur at any time without notice and will be displayed on our website. The URLOCAL Terms of Service Agreement (this document). We suggest that you check regularly to see if there have been any changes to the current Terms of Service agreement.

Enforcement of the terms and conditions.

Depending on the circumstances of the conditions of any violation, URLOCAL reserves the right to hold the client liable for any damages, downtime, excessive load, or harm to people or systems. Account termination may occur at URLOCAL's discretion.

Privacy.

All personal information submitted to URLOCAL will be kept strictly confidential and used solely for internal purposes for which it was intended, and for the benefit of the Customer.

We agree not to sell, distribute, share or release this information to any other party, for any reason, without the specific written consent of the Customer, unless required by law, regulation or government authority.

Customers may receive periodic email's from us concerning system upgrades or other network related information. These emails will not be marketing related, they will be aimed at customer satisfaction.

Illegal Activities.

We are required by law to report any and all illegal activities that we become aware of. If we become aware that a Customer is using our systems to commit illegal acts (ie. storing of illegal software, adult material, etc.) immediate account suspension will occur.

Furthermore, the Customers agrees that URLOCAL may disclose any and all Customer information to any law enforcement agent who makes a written request without further consent or notification to the Customer.

Spamming.

Spamming, or the sending of unsolicited email, from a URLOCAL server or using an email address that is maintained by URLOCAL is prohibited and will qualify your site for immediate deactivation with no refund. URLOCAL will be the sole arbiter as to what constitutes a violation of this provision. Clients may be liable for a cleanup fee associated with this activity. Other charges may apply.

Payments and Billing.

Charges and fees accrue from the time you commence using our services until the time your formally cancel service via a written, signed notice via email, post or FAX. Services may be suspended on accounts that are not paid in full by or on there due date. We reserve the right to remove any account for any reason at any time without prior notice.

Refunds.

All payments for hosting services are NON-REFUNDABLE!

Cancellation.

Customers may terminates URLOCAL Services at any time by providing URLOCAL with (7) days notice. All cancellations of services must be sent by a written, signed notice via email, post or FAX. While there are no cancellation fees, any prepaid amounts are NOT refundable.

URLOCAL may terminate the Service for any reason by giving the Customer (7) days notice.

Domain Name Issues.

All domains hosted at URLOCAL, or using our DNS servers will be kept in URLOCAL's possession until the customer has paid all past debts to URLOCAL. We will not process any request to move any domain until the account has a "zero-balance." Similarly, we cannot move domains from other ISP's in cases where unpaid debts to the former ISP are a problem.

Backup of Data.

URLOCAL does all within its power to provide stable, trouble-free systems, however, nothing is fail-safe. For that reason, URLOCAL highly recommends that all customers keep a current backup of their data.

Disclaimer.

URLOCAL disclaims any and all responsibility for the loss of, or damage to, any customer data stored on our system, or for any consequential damages related to such loss, damage, or unavailability. URLOCAL's services are provided with no warranty or merchantability or fitness for a particular purpose. In no event shall URLOCAL be liable for incidental, consequential, or special damages including, without limitation, loss of data or profits, regardless of whether URLOCAL has been advised of the risk of such damages in advance. By using our services at any time, you unconditionally agree to indemnify and hold harmless URLOCAL from and against loss, suit, damage or claim including reasonable solicitor’s fees.

USE OF OUT SERVICE CONSTITUTES YOUR APPROVAL AND ACCEPTANCE OF THIS AGREEMENT. ACCEPTANCE OF THIS AGREEMENT IS A CONDITION OF USE OF THE URLOCAL NETWORK SYSTEM AND SERVICES. BY PLACING AN ORDER YOU AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT.

YOU ACKNOWLEDGE THAT THIRD PARTY PRODUCTS AND SERVICES MAY BE ADVERTISED ON THE URLOCAL WEB SITE AND THAT URLOCAL MAY FORM ALLIANCES WITH SOME OF THESE VENDORS FROM TIME TO TIME IN ORDER TO FACILITATE THE PROVISION OF THESE PRODUCTS AND SERVICES TO YOU. HOWEVER, YOU ACKNOWLEDGE AND AGREE THAT AT NO TIME IS URLOCAL MAKING ANY REPRESENTATION OR WARRANTY REGARDING ANY THIRD PARTY'S PRODUCTS OR SERVICES, NOR WILL URLOCAL BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY CLAIMS ARISING FROM OR IN CONNECTION WITH SUCH THIRD PARTY PRODUCTS AND SERVICES. YOU HEREBY DISCLAIM AND WAIVE ANY RIGHTS AND CLAIMS YOU MAY HAVE AGAINST URLOCAL WITH RESPECT TO THIRD PARTY PRODUCTS AND SERVICES, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
